Halos of the St. Croix Valley and the
City of Chippewa Falls
Run/Walk Participant Agreement, Release & Assumption of Risk

Halos of the St. Croix Valley and the City of Chippewa Falls owners, officers, affiliates, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf, I hereby agree to of myself, release, my spouse, indemnify my children, my parents, my heirs, assigns, personal representative and estate as follows:

1. I acknowledge that my participation in Halos of the St. Croix Valley’s Memorial Run/Walk Family Fun Day games or activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. The risks include, among other things: Halos of the St. Croix Valley’s Run/Walk entail certain risks that simply cannot be eliminated without jeopardizing the essential qualities of the activity. Halos Memorial Run/Walk expose its participants to the usual risk of cuts and bruises. Other more serious risks exist as well. Participants often fall off equipment, sprain or break wrists, ankles and legs, and can suffer more serious injuries as well. Traveling to and from Halos Memorial Run/Walk Family Fun Day locations raises the possibility of any manner of transportation accidents. Participants often fall on each other resulting in broken bones and other serious injuries. In any event, if you or your child is injured, you or your child may require medical assistance, at your own expense. Furthermore, Halos of the St. Croix Valley’s employees and volunteers have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participators abilities. They may give incomplete warnings or instructions, and the equipment being used might malfunction.

2. I hereby declare, assert and affirm that participation in the Halos of the St. Croix Valley’s Run/Walk is done having voluntarily and knowing assumed ALL RISKS involved in this event. The immediate physical risks and hazards associated with normal, vigorous physical activity include (but are not limited to) physical discomfort, fatigue, muscular soreness, falls, pulled or strained muscles, overuse injuries, heat stress, and the rare instance of abnormal responses of the cardiorespiratory system including heart arrhythmia, heart attack, stroke, and sudden death.

3. I expressly agree and promise to accept and assume all of the risks existing in this activity. Participation in this activity is purely voluntary, and I/we elect to participate in spite of the risks.

4. RELEASE OF LIABILITY: I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Halos of the St. Croix Valley and the City of Chippewa Falls from any and all claims, demands, or causes of action, which are in any way connected with my participation in Halos of the St. Croix Valley’s Memorial Run/Walk Family Fun Day activities or my use of equipment or including any such claims based upon damages caused or alleged to be caused in whole or in part by the negligent acts or omissions of Halos of the St. Croix Valley and the City of Chippewa Fa;;s.

5. Should Halos of the St. Croix Valley and the City of Chippewa Fa;;s or anyone acting on their behalf, be required to incur agreement, attorney’s agree indemnify fees and hold them harmless for all such fees and costs.

6. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

7. In the event that I file a lawsuit against Halos of the St. Croix Valley and the City of Chippewa Fa;;s, I agree to do so solely in the state of Wisconsin, and I further agree that the substantive law of Wisconsin shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Halos of the St. Croix Valley and the City of Chippewa Falls on the basis of any claim from which I have released them herein. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.

8. I further grant Halos of the St. Croix Valley and the City of Chippewa Falls, the right to photograph, videotape, and/or record me and/or my child and to use my or my child’s voice and appearance in connection with exhibitions, publicity, advertising and promotional materials without reservation or limitation.
